Hi,

I just heard this evening (and read over internet news) that a case of pulmonary anthrax may have been identified in Florida.

Is this true, or is this just hysteria?

The only Florida strain of B. anthracis that I am familiar with is V770, which is the parent of V770-NP1-R, the strain used in production of the human anthrax vaccine.

The article said that this person was an “Outdoorsman,” and had drunk water from a creek in North Carolina.

I know that in the wild in Africa, animals are supposed to be able to get it from water holes by stirring up spores and presumably ingesting and possibly inhaling them as an aerosol. Could this have happened?

Please don’t hesitate to give me a call if there’s anything I can do.

We are currently testing the virulence (in immunized and unimmunized guinea pigs) of B. anthracis strains from all over the world, including China, and we’ve come up with some very interesting differences in virulence among the strains.

Take care of yourself,

Bruce

DXer points out … the DOJ Summary quotes Dr. Ivins’ 9/26/01 e-mail …

  • “I just heard tonight that the Bin Laden terrorists for sure have anthrax and sarin gas.”
  • The Summary argues that it was before the letters were sent and so he could not possibly have been parroting the letters.

That’s right.  He wasn’t parroting the letters.  He was just reporting on national news he heard that day — just like he says on the face of the email that DOJ has failed to produce.

  • Washington Times’ national security columnist had just reported on Bin Laden terrorists and  anthrax and sarin gas.
  • “Intelligence officials say classified analysis of the types of chemicals and toxins sought by al Qaeda indicate the group probably is trying to produce the nerve agent.  Sarin, or biological weapons made up of anthrax spores. Sarin can be produced from the components used to make fertilizer and kills by disrupting the central nervous system. Anthrax is a highly lethal biological weapon that causes death after spores are ingested.”
  • The AUSA in charge of Amerithrax was lambasted for deliberately mischaracterizing the evidence in a decision dismissing the indictments against the Blackwater defendants.
  • The DOJ took no steps to disclose the September 26, 2001 media report even after it was pointed out in August 2008 by blogger EmptyWheel and others.

from DXer …

  • Much of the evidence the FBI relies upon might not even be admissible.
  • The most central evidence one would want to consider would be the notations he made in his Lab Notebook 4010 on the dates the FBI alleges he was preparing the anthrax that killed 5 people.
  • His observations on the health of the animals he made in connection with the animal study he was working on.
  • Where has the DOJ provided those pages? They clearly are discoverable under FOIA.  They clearly are relevant.  Could someone identify for me where they are produced?
  • If they weren’t produced, it would be a game of hide-the-ball.

* DXer … Why weren’t all of Dr. Ivins emails provided as required under the Freedom of Information Act?

* the withholding of information by various federal agencies has led to many complaints; here are examples of information withheld by the FBI, NAS, EPA and FAA.

* a few of the critical pieces of information the FBI/DOJ are still hiding in apparent violation of FOIA requirements to disclose

LMW COMMENT …

The FBI’s case against Dr. Ivins is bogus: no evidence, no witnesses, an impossible timeline. The real question is why the FBI persists in sticking to such a pathetic story. What are they hiding?

* Antipolygraph.org provides a fascinating analysis of the FBI’s unsupported assertions regarding Dr. Bruce Ivins’ polygraph tests

Posted by DXer on February 23, 2010

.

The FBI’s case against Dr. Ivins is clearly bogus: no evidence, no witnesses, an impossible timeline, science that proves innocence instead of guilt.

So what really happened? And why? The “fictional” scenario in my novel CASE CLOSED has been judged by many readers, including a highly respected official in the U.S. Intelligence Community, as perhaps more plausible than the FBI’s unproven assertions.

Antipolygraph.org provides a fascinating analysis

of the FBI’s unsupported assertions

regarding Dr. Bruce Ivins’ polygraph tests

******

Excerpts …

  • The DOJ maintains that Dr. Bruce Ivins, who in 2002 passed a polygraph test regarding the anthrax attacks, was the sole perpetrator.
  • In an investigative summary, the DOJ characterizes Ivins’ passing of the polygraph as part of an effort to “stay ahead of the investigation,” alleging (at p. 84, fn. 51) that he used countermeasures to fool the polygraph.
  • While FBI and DoD polygraphers claim that Ivins showed “classic” signs of countermeasure use, it should be noted that no polygraph operator has ever demonstrated the ability to detect polygraph countermeasures.
  • The question of whether an alleged biological terrorist fooled the polygraph is a crucial one for national security. The polygraph remains the centerpiece of America’s personnel security policy–despite the conclusion of the National Academy of Sciences that it’s junk science.
  • In addition, comments that Ivins allegedly made regarding his polygraph examination suggest that he really did not understand polygraph procedure.
