LMW COMMENT …

The FBI’s case against Dr. Ivins is bogus: no evidence, no witnesses, an impossible timeline. The real question is why the FBI persists in sticking to such a pathetic story. What are they hiding?

“At the end of the aerosol challenge approximately six (6) or seven (7) ml of B.a would remain. The B.a. that was not used in the challenge was normally autoclaved prior to being removed from the hood. The remaining material, except fro theAGIs, that was used in the challenge would be placed into a bag and autoclaved at the end of the day. The AGIs were sprayed with bleach prior to being removed from the hood line, and then taken to room ___ for plating. After the plates had been left in the incubator overnight, they would be completely covered with growth. The pjates ere then read in the morning following a challenge. After the plates were read, they were placed into a bag and clearly marked with what pathogen was in the bag, what strain the pathogen was, and who the investigator was. The bags would remain in room ___ until nearly overflowing, or until the number of bags in the room became an obstruction. The bags often sat in room ___ for several days or weeks prior to being to being removed. _________ noted that___ was fascinated with how much growth appeared on the plates after several days or weeks. The bags were then taken to the basement to be autoclaved. The bags were placed into metal garbage cans in the basement, next to the autoclave, incase there was a leak in the bag.”

The conicals used in the all glass impingers (AGI)were fifteen (15) ml. The B.a. Ames that was used in the post-challenge plates came from the fifteen (15) ml AGI conicals would be stored in racks, in the refrigerator for one (1) or two (2) days, in room 115. The DOJ Summary states:

First, the specific language of the anthrax letters tracked the rambling e-mail of more than two pages that Dr. Ivins sent to Former Colleague #1 [Mara] on September 26, 2001, as
    follows:

    9/26/01 e-mail:
“I just heard tonight that the Bin Laden terrorists for sure have anthrax and sarin gas.”

The Summary argues that it was before the letters were sent and so he could not possibly have been parroting the letters.

That’s right. He wasn’t parroting the letters. He was just reporting on national news he heard that day — just like he says on the face of the email that DOJ has failed to produce.

Washington Times’ national security columnist had just reported on Bin Laden terrorists’ and anthrax and sarin gas.

“Intelligence officials say classified analysis of the types of chemicals and toxins sought by al Qaeda indicate the group probably is trying to produce the nerve agent. Sarin, or biological weapons made up of anthrax spores. Sarin can be produced from the components used to make fertilizer and kills by disrupting the central nervous system. Anthrax is a highly lethal biological weapon that causes death after spores are ingested.”

The AUSA in charge of Amerithrax was lambasted for deliberately mischaracterizing the evidence in a decision dismissing the indictments against the Blackwater defendants.

The DOJ took no steps to disclose the September 26, 2001 media report even after it was pointed out in August 2008 by blogger EmptyWheel and others.
