- In a lengthy interview, AUSA Rachel Lieber recently affirmed her confidence to Frontline interviewers in Dr. Ivins guilt.
- Yet when you go to the February 2010 Amerithrax Investigative Summary that she wrote — which reflects her understanding of the facts — there is no mention whatsoever of the 52 rabbits over which Dr. Ivins had charge and which were the reason he was in the lab.
- The rabbits delivered on September 25 and subject of the experiments in early October 2001.
- The word “rabbit” nowhere appears in her lengthy report!
- Instead, at page 32, in a footnote, she refers to only some mice needing his attention and says that they would not have explained all his time.
- Rather than relying on a review of the documents, she relied on Pat Fellows’ self-serving characterizations.
- In short, in the rush of events in July 2008, it is understandable that Rachel had not mastered the facts — alleged to Ivins’ counsel that Dr. Ivins used a lyophilized etc.
- Heck, she had the private knowledge of what the first counselor, Judith (who reports she feared nasty astral entities were trying to kill her) had said about what the murderous Dr. Ivins had told her in July 2000 about his murderous plans.
- With that fueling their suspicion of Dr. Ivins, who wouldn’t be suspicious?
- And the first counselor’s delusions are explained quite clearly in her 2009 book that was available to Rachel to read before issuing her 2010 report.
- But what’s her excuse for failing to explain in February 2010 the reason Dr. Ivins was in the lab –which is established by the documentary evidence she nowhere mentions and that DOJ has not uploaded?
- What’s her excuse for telling me that we would never get the lab notebooks showing how he had spent his time under FOIA?
- After Dr. Ivins killed himself, there was no meaningful reassessment of the case. Ken Kohl was busy dealing with the aftermath of the botching of the Blackwater murder prosecution.
- The Amerithrax Investigative Summary is an unsourced and unmitigated crock — not supported by citation to any documentary evidence for good reason.
- An analysis sourced to the documentation tells a quite different story.
- As an example, all the letters claimed by Rachel to have been double-lined in fact were not.
- Isn’t the country sick and tired of the CYA motivation of federal officials potentially putting the country at peril?
- The Amerithrax Investigative Summary should have been sourced to the documents which should have been provided in an Appendix.
- They now should be uploaded under FOIA — before 9/11 please.

LMW COMMENT …
The buck stops with FBI Director Robert Mueller. Congress should demand an explanation of the pathetic FBI anthrax investigation.
It is this purposely misleading behavior by FBI Director Mueller and Attorney General Holder and their subordinates which infuriates me. That fury caused me to write my novel CASE CLOSED, which posits an alternative (fictional) scenario for what really happened in the anthrax attack and in the FBI investigation which followed.

extracts from a recent DXer comment …
- Bruce Ivins supplied a Cairo Medical graduate, whose friends were personally recruited by Dr. Ayman, virulent Ames.
- Dr. Ivins was directed to do so even though the researcher was not a US citizen. Bruce did not know the researcher was a non-citizen until after the visiting scientist arrived at USAMRIID for the visit in Spring 1998. See generally INSIDE JIHAD, by “Tawfiq” Hamid about Dr. Ayman’s recruitment at Cairo Medical.
- Dr. Tarek Hamouda was funded by DARPA.
- The researchers who shared a suite with Ali Al-Timimi also were funded by DARPA.
- Those researchers co-invented the microencapsulation patent used to concentrate anthrax with silicon dioxide.
- Ali Al-Timimi was coordinating with fellow Falls Church imam, Anwar Awlaki.
- The FBI’s anthrax expert, John Ezzell, spoke at DARPA about his dried aerosol project at USAMRIID. Over the course of 5 years of trial and error, according to author DW, he experimented with making a dried powder.
The FBI never disclosed this — not to the public
and apparently not to the NAS.
- We all just want the right answer. That requires a Congressional Commission or a reopened Amerithrax investigation.
- Agent Lawerence Alexander was not provided the 16 pages of the research by the former Zawahiri associate
alongside Bruce Ivins and Patricia Fellows in the B3 until well after he had started googling about sororities and developed the early forms of his “Ivins Theory.”
- His theory, though speculative and complex, can be presumed to be in good faith. But at the end of the day he needs to factor in what he now knows about the reliability of the first counselor as a witness.
Agent Lawrence Alexander and Postal Inspector Dellefera
have to themselves urge the Director that Amerithrax be reopened.
- The small company of the former Zawahiri associate received millions from the venture fund headed by the man who then was put in charge of Pakistan and Afghanistan (the powerful #3 at Department of State).
- That combined with the fact that Ali Al-Timimi had once been the assistant by the former White Chief of Staff (in another life at the Department of Transportation) may have made the correct solution of Amerithrax politically awkward.
- Our United States Department of Justice closed its case based on someone who was having visions, hearing voices and a series of mistaken claims and premises outlined at an August 8, 2008 conference.
- our major media has not yet interviewed Tarek Hamouda, the former Zawahiri associate, to ask how well he knew Dr. Ayman Zawahiri and his sister, the microbiology professor.
- No one has interviewed the subtilis expert who lived 20 miles from the Princeton mailbox who was in regular phone contact with the WTC 1993 plotters to ask how well he knew Ramzi Yousef, KSM’s nephew.
- Dr. Hamouda, the former Zawahiri associate, thanked Patricia Fellows for providing technical assistance.
- She is the one who spun Dr. Ivins as having no reason to be in the lab in early October. See her 302.
- For 2 1/2 years, the DOJ did not mention that Dr. Ivins was helping with the animal studies on not only the 5 nights in September that the DOJ was speculating that he was making a dried powder.
- And even to this day they never have disclosed that the same animal work continued in October.
This withholding of documents is outrageous.
- It is critical that the GAO probe who is responsible for the withholding of documents and force the disclosure of all documents relating to Amerithrax not exempt from FOIA.

- It is an open blog. Anyone can contribute.
- And yet, to the best of my recollection …
not a single person has presented
a single bit of documentation
in support of the FBI’s assertion that Dr. Ivins
made the attack anthrax and mailed the letters.
- If you’re out there, and you have evidence that supports the FBI’s case, let’s see it.
- Meanwhile, the mountain of grudgingly released documents continues to demolish the FBI’s assertions.

reporters need to learn what the FBI hasn't told

We need actual investigative reporting and not merely a retread of what we know. That requires document discovery through FOIA and interview of people like Patricia Fellows, Mara Linscott, Terry Abshire and Joany Jackman about the DARPA research in which they all participated. Holes pointed out by genetics experts are meaningless when the genetics only narrowed things to an estimated “up to 377” between Building 1412 and Building 1425 in the first place.
For example, perhaps USAMRIID has the documents relating to the necropsies conducted on the mice in late September 2001 and the rabbits in early October 2001. It boggles my mind that no reporter has even bothered to obtain the 302 interview statements of the family members or the September 17, 2001 email to Mara Linscott (so as to be able to see the time it was sent). I realize these journalists are overworked (and handle a wide range of important matters) but it only takes minutes to submit a FOIA request.

The FBI’s case against Dr. Bruce Ivins has been demonstrated to be bogus. So what really happened? And why? I offer one “fictional” scenario in my novel CASE CLOSED, judged by many readers, including a highly respected official in the U.S. Intelligence Community, as “quite plausible.”

The New York Times says the FBI’s anthrax case has “too many loose ends.” Find out where some of those looses ends might have originated in my novel CASE CLOSED. Sure it’s fiction, but many readers, including a highly respected member of the U.S. Intelligence Community, think my premise is actually “quite plausible.”

- Records recently provided by the US DOJ suggest that Dr. Ivins did not know that one of the two researchers coming was not a US-citizen.
- Tarek Hamouda, the head of a DARPA project, was from Cairo, Egypt and had a green card.
- Permission was granted after his arrival to work with Bruce Ivins in the B3 laboratory.
- The researcher, Tarek Hamouda, and his co-inventor, James Baker, were working on a decontamination agent that later was tested at the US Capitol clean-up and pitched to postal workers as a hand cream.
- Lab tech Michael Hayes accompanied Dr. Hamouda to do the work with Dr. Ivins in May 1998.
- The Ann Arbor researchers thanked Bruce Ivins for supplying them the Ames and also thanked Patricia Fellows, Mara Linscott, and Arthur Friedlander for technical assistance.
- DXer has reported that a lifelong childhood of Dr. Hamouda, “Tawfiq” Hamid, has published on his experience of being recruited into the Egyptian Islamic Jihad by Ayman Zawahiri in a room set aside for that purpose at the Cairo Medical School.
- Dr. Hamid consults with the Intelligence Community.
- The recruitment occurred while he and Dr. Hamouda were both attending Medical school. Dr. Hamouda graduated in December 1982 and then got his PhD from Cairo Medical in 1994. By 1997 he was in Ann Arbor and head of the DARPA project.
- Before 911, Dr. Hamid called his friend Dr. Hamouda to ask about patents and Dr. Hamouda reportedly said it was all in the marketing.
- DXer reports that Dr. Hamid told him that Dr. Hamouda would visit Cairo from Khartoum and they would go to the comic store together with Dr. Hamid’s brother, a St. Louis MD.
- DXer asks:
- Why wasn’t Dr. Ivins told that he was being asked to supply virulent Ames to a non-citizen?
- Why are the nearly 20 pages concerning that research not provided until 2005?
- Why is it Dr. Ivins’ fault that a non-citizen was sprung on him without notice?
