United States District Judge Leonie M. Brinkema has issued an order dated November 21, 2016 stating in pertinent part:

“This Court has taken the position that challenges to convictions under 18 U.S.C. Sec. 924(c)(3)(B) should be stayed to await the Supreme Court’s decision in Lynch v. Dimaya, No.15-1498, which should issue this term.”

It seems that given the political orientation of the new Administration, AUSA Kromberg would be a good bet for promotion at the DOJ. The briefing by Al-Timimi’s legal team has been as high quality as the legal team’s efforts have been persistent. Agree or disagree on the merits of the legal issues of the constitutional and other issues presented, AUSA Kromberg has certainly paid his dues on the frontline and in the trenches.

If Ali Al-Timimi’s conviction is overturned, it would be fascinating to read a book about written by him about sharing the suite with Russian bioweaponeer Ken Alibek and former USAMRIID Commander Charles Bailey.
