    Illinois, Wisconsin, Georgia… drills are being held across the country to prepare for an anthrax attack. In Frederick County, MD last month, Meals on Wheels were used to distribute antibiotics in the drill.

    Yet the FBI and Medcom does not expedite requests relating to the Fall 2001 anthrax attacks. Indeed, Army Medcom has not even uploaded the documents provided to it by the FBI some years ago for processing.

    Given that the Army was the originating agency for all the contemporaneous evidence, this left the FBI’s Vault just a selective collection of highly edited (redacted) FBI 302 interview statements rather than the contemporaneous documents themselves.

    Maybe if the US Army left it to Meals on Wheels to distribute the documents (as was done in Frederick County, MD) it might get done quicker.

    The way that the FBI has been able to withhold a staggering amount of exculpatory of evidence — and it is the former lead Amerithrax investigator who is alleging a staggering amount of exculpatory informatio is being withheld — was only by the cooperation of US Army FOIA Medcom operation. All the Army needed to do was sit on its hands, delay, and do nothing to process the documents that had been referred to it for processing by the FBI.

    The FBI in its production has deleted numerous entire pages as indicated by the phrase “Referral/Direct.” USAMRIID FOIA has made no effort to process the pages and upload them in its USAMRIID Electronic Reading Room.

    Above are the pages deleted by the FBI and yet never processed by the Army for Part 04 — which is just one part among 59. Below are the pages for Parts 1, 3, 5, 27, and 29. I will go through the remaining sections identifying the pages that Army, as an institution, knowingly failed to process for disclosure.

    Where the FBI took the only copy of pages to present to the grand jury, that left the Army’s Electronic Reading Room merely busy work for those not in the secret of what was being withheld. The joke’s on me. I feel like such a schlemiel and dupe.

    Turning to Part 06, Bruce Ivins’ “Laboratory notes, computer files, and other documentation kept by Bruce Ivins were among the subjects of the 110 pages deleted by the FBI from Part 06. Yet, the USAMRIID failed to produce them or acknowledge their existence under FOIA, even though they were sought for years in the course of numerous requests. Most recently, the request was made to the FBI in the request by Ken Dillon above. But I’ve made the same request to USAMRIID.

    Many of the 110 pages referred to the USAMRIID in Part 06 are appropriately exempt from production under (b)(6). But those relating to Bruce Ivins most definitely were NOT.

      To check on the status of an existing request or related matters, you may call David P. Sobonya, FOI/PA Public Information Officer, at (540) 868-4593. I called Mr. Sobonya and explained that the Amerithrax documents uploaded in the FBI’s Vault did not identify the agency to which the hundreds of pages of documents had been referred. He said I would have to submit a FOIA request to inquire.

      In part 55 of 59, for example,

      Pages 21, 22, 23, 27, 28, 29, 30, 31, 32, 33, 34, 35 were deleted and “Referred/Direct.”
