    The FBI says it refused to provide NAS some classified documents, in part, because it wanted to spare a third country some embarrassment. Which country was that?

    Pakistan? Because a current government scientist was working in Al Qaeda’s anthrax lab?

    Malaysia? Because a current government scientist (who claims to have been part of a secret biological weapons program) was working in Al Qaeda’s anthrax lab?

    The UK? Which hosted the Al Qaeda scientist at an international Dangerous Pathogens conferences — where the Al Qaeda scientist obtained samples? UK? Where the AQ was hosted at a lab (hint: probably a government lab) with 1000s of pathogens in the B3. He was allowed access in 1999 after training. Senator Leahy says that when the government wants to hide a screw-up, they just stamp it classified. He says Amerithrax is not closed.

    Wouldn’t the public understanding of Amerithrax have been furthered to know that the Al Qaeda scientist was taking home anthrax with the hotel towels — after having beers with the Porton Down and USAMRIID scientists … and that there was a whole lot less reason to suspect that Iraq had been the source?

    The US might not have invaded Iraq.

    ISIS might not have risen.

    Malaysia’s Businessman andformer military officer Yazid Sufaat, who is now detained under the Internal Security Act for activities prejudicial to national security, will not be extradited to the United States, Deputy Prime Minister Abdullah Ahmad Badawi said Monday.

    “As far as we are concerned, he has committed a serious offenseand we cannot hand him over to others to be extradited,” Abdullah told a news conference here.

    The government would deal with Yazid according to the laws of the country, he said.

    Abdullah added that detention of individuals found involved in terrorism-related activities would continue.

    A local newspaper reported that the United States was seeking to extradite Yazid to faces charges in the United States in connection with last year’s September 11 attacks in New York and Washington.

    Yazid was arrested on last December at the Bukit Kayu Hitam immigration checkpoint while returning by land via Thailand from Pakistan.

    Separately, the February 4 issue of Newsweek said U.S. intelligence agencies believed Yazid was a member of Jemaah Islamiah which the news magazine described as an Islamic extremistgroup that befriended Osama bin Laden and helped him develop a support network in Malaysia and throughout Southeast Asia.

      The Malaysia’s afternoon daily, The Malay Mail, on Thursday quoting the New York Times report that Bush administration officials, said an Al-Qaeda operative arrested in Malaysia “has begun cooperating with investigators and provided new evidence to show that the country was a major staging area for the Sept 11 terror attacks in the United States.” It said the suspect, a former Malaysian Army captain, had acknowledged meeting in Malaysia with at least two of the Sept 11 hijackers, as well as with Zacarias Moussaoui, the 33- year-old French citizen, who is now in Virginia jail cell.

      Officials said [Yazid] appeared to have operated as a paymaster for Moussaoui, who was arrested in the US last August after he raised suspicions among his instructors at a Minneapolis flight school, and to have provided him with phony business credentials from a Malaysian technology company.

      American and Malaysian officials said they believed that Yazid was a crucial organizer of a gang of extremists called the Malaysian Militant Group or Jemaah Islamiah, that is part of Osama bin Laden’s Al-Qaeda terrorist network.

      Yazid was one of 23 people believed to be extremists detained by Malaysian police in the last two months.

      Officials said Yazid appeared to have operated as a paymaster for Moussaoui, who was arrested in the US last August after he raised suspicions among his instructors at a Minneapolis flight school, and to have provided him with phony business credentials from a Malaysian technology company.

      They said they had found evidence that Yazid provided Moussaoui with at least US$35,000 in meetings near Kuala Lumpur in September and October 2000.

      American investigators said that Moussaoui deposited about US$32,000 a few months later in a bank account in Norman, Oklahoma where he first attended flight school.

      Lawyers for Moussaoui, who is of Moroccan descent and who has been linked by French intelligence agencies to Al-Qaeda, have entered a plea of not guilty on his behalf, on charges that he conspired in the Sept 11 attacks.

      American officials said the evidence showed that Yazid had met in January 2000 with two of the Sept 11 hijackers, Khalid al-Midhar and Nawaq Alhazmi, at his condominium outside Kuala Lumpur.

      Midhar and Alhazmi subsequently traveled to the US for flight training, and they were among the suicidal hijackers who commandeered the American Airlines jet that crashed into the Pentagon on Sept 11.

      Officials had previously acknowledged that Midhar and Alhazmi were under surveillance on their trip to Malaysia, and that as a result of their meetings in Kuala Lumpur with Al-Qaeda operatives, they were placed on an immigration watchlist in the US.

      By the time their names were added to the list, however, the two men had already entered the US.

      Investigators said that Muslim extremists in Malaysia appeared to have organized “sleeper cells” of Islamic militants throughout Southeast Asia, and that they might have given direction to a network based in neighboring Singapore that had planned to blow up embassies there of the United States, Israel, Australia and Britain.

      The plot was apparently foiled when 13 terror suspects were arrested in Singapore in recent weeks.

      During questioning, officials there said the suspects described a well-organized terror network stretching across several nations in Southeast Asia, including the Philippines which has a large Muslim population, and Indonesia, the world’s most populous Muslim nation.

      On Monday, Malaysian Deputy Prime Minister Abdullah Ahmad Badawi said Yazid will not be extradited to the United States.

      The national Bernama news agency said Badawi, who is also minister of Home Affairs, was commenting on a New Sunday Times report that Washington had requested the extradition of Yazid in connection with the September 11 attacks on Washington and New York.

      Yazid, a businessman and former army officer, was arrested on the Malaysian-Thai border when returning from Pakistan in December.

      “As far as we are concerned, he has committed a serious offense and we cannot hand him over to others to be extradited,” said Badawi.

      A US Embassy spokesman in Kuala Lumpur said its policy was not to comment on whether any extradition request had been made.

    JERUSALEM: Israel has secretly detained a suspected al-Qaeda biological weapons expert for more than three years, court documents disclosed on Monday, after the man appealed to the Israeli Supreme Court to free him.

    Samer al-Baraq studied microbiology in Pakistan, underwent military training in Afghanistan and was recruited in 2001 to al-Qaeda by Ayman al-Zawahri, who is the group’s leader today, Israeli prosecutors said in documents seen by Reuters.

    They said he was planning attacks against Israelis.

    But Al-Baraq, 39, has not been charged and has been held since 2010 in administrative detention, a policy by which Israel jails suspected militants without trial, based on evidence presented in a closed military court.

    Israel says the practice pre-empts militant attacks against it while keeping its counter-intelligence sources and tactics secret. In October, Al-Baraq appealed to Israel’s Supreme Court to end his military detention.

    Asked if his client denied the allegations against him, al-Baraq’s lawyer, Mahmid Saleh, told Army Radio: “If he is such a senior terrorist, then why hasn’t he been prosecuted? There is no evidence against him.”

    According to a court document al-Baraq was once detained and questioned in the United States and was later jailed in Jordan for five years. He was arrested in 2010 when trying to enter Israel from neighbouring Jordan.

    In its response to al-Baraq’s appeal, Israel’s prosecution said letting the detainee go would endanger the entire region. The Supreme Court was due to hold a hearing in the case later on Monday.

    It cracks me up that the fellow making these key decisions for the FBI on WMD, Dr. Majidi, thinks that if Rauf Ahmad had guilty knowledge, he would have claimed responsibility.

    The way it works Vahid, is that defendants lie. You can see from FBI Agent Borelli’s description of the interrogation of Rauf Ahmad in February 2002 that Rauf was lying.

    That’s why instead of contenting yourself with tea and cookies, the FBI should have extradited his ass to the United States.

    Yazid Sufaat took to bragging about the 3000 killed on 911 — and telling me that he could work magic with anthrax — and he promptly was thrown back in prison.

    Of course, given the perpetrator was US-based and there is no reason to think he is dead, then the operative likely is still exposed to arrest.

    Vahid’s entire Al Qaeda / anthrax argument is based on his specious assumption that Al Qaeda would claim responsibility when any competent analyst knows that Bin Laden/Zawahiri denied both 911 and the 1998 embassy bombings until they were beyond reasonable dispute.

    If this is the quality of Vahid’s counterintelligence analysis, it is a miracle that Dr. Zawahiri has not been able to pull off a WMD attack.

    If and when Dr. Zawahiri does attack the US with anthrax, or claim responsibility, it will be Dr. Majidi’s fault in not correcting himself on whether Dr. Ivins was working in the B3 with the 52 rabbits.

    It was a simple matter for Dr. Majidi to check — and I have emailed him links to the uploaded documents and corresponded with him about them.

    He cannot and does not point to any documents whatsoever to support his claim. I have read every document and page made part of the FBI’s record — and then thousands of pages produced by USAMRIID.

    This issue whether Dr. Ivins was working on the experiment in the last week of September 2001 and first week of October 2001 is dispositive of Majidi’s entire “Ivins Theory.”

    I promised Vahid confidentiality but I can assure you that I would promptly link any document he ever found that supported his claim(s).

    There reason he is so spare on citations in his book — that is because the record does not support his claims.

    The 1998 embassy bombing participant, Anas Al-Liby was extradited 14 years after the bombing. He was living openly in London and then Libya.

    In his new manuscript, Dr. Majidi writes:

    “The embassy bombings and numerous international terrorist attacks in 1980s and 1990s was directly responsible for creation of the Counterterrorist Division.”

    Dr. Majidi was the WMD guy. After he joined the DOJ, what did he do to urge the extradition of Al Qaeda anthrax scientists Rauf Ahmad and Yazid Sufaat?

    How does it deter such activities if Rauf Ahmad was allowed to go back to his government day job?

    Or in the case of Yazid Sufaat, how does it deter such activities if he was allowed to brag in the media about the murder of 3000 on 911 and argue it was good marketing for Islam?

      In pleading guilty with regard to the surveillance of the 1998 embassies — that allegedly was done with Anas Al-Libi, who now has been brought to New York City for trial — Ali Mohammed said that Zawahiri came to the United States twice in the early 1990s.

      My original contribution in December 2001 was that the FBI should make a priority tracking who Zawahiri met on his visit to the US — they likely would find their mailer. Ali Mohammed at one point had travelled to Afghanistan to tell Bin Laden that they had recruited 10 sleepers.

      Adnan El-Shukrijumah, who I have suggested was the mailer of the Fall 2001 anthrax mailings, was the son of the Blind Sheik’s interpreter in Brooklyn.

      THE DEFENDANT: Your Honor, in the early 1980s I

      23 became involved with the Egyptian Islamic Jihad organization.

      24 In the early 1990s, I was introduced to al Qaeda — al Qaeda

      25 is the organization headed by Usama bin Laden — through my

      1 involvement with the Egyptian Islamic Jihad.

      2 In 1992, I conducted military and basic explosives

      3 training for al Qaeda in Afghanistan. Among the people I

      4 trained were Harun Fadhl and Abu Jihad. I also conducted

      5 intelligence training for al Qaeda. I taught my trainees how

      6 to create cell structures that could be used for operations.

      7 In 1991, I helped transport Usama bin Laden from

      8 Afghanistan to the Sudan.

      9 When I engaged in these activities, and the others

      10 that I am about to describe, I understood that I was working

      11 with al Qaeda, Bin Laden, Abu Hafs, Abu Ubaidah, and that al

      12 Qaeda had a shura council, which included Abu Hajer al Iraqui.

      13 In the early 1990s, I assisted al Qaeda in creating a

      14 presence in Nairobi, Kenya, and worked with several others on

      15 this project. Abu Ubaidah was in charge of al Qaeda in

      16 Nairobi until he drowned. Khalid al Fawwaz set up al Qaeda’s

      17 office in Nairobi. A car business was set up to create

      18 income. Wadih el Hage created a charity organization that

      19 would help provide al Qaeda members with identity documents.

      In late 1993, I was asked by bin Laden to conduct

      2 surveillance of American, British, French, and Israeli targets

      3 in Nairobi. Among the targets I did surveillance for was the

      4 American Embassy in Nairobi, the United States AID Building in

      5 Nairobi, the United States Agricultural Office in Nairobi, the

      6 French Cultural Center, and French Embassy in Nairobi. These

      7 targets were selected to retaliate against the United States

      8 for its involvement in Somalia. I took pictures, drew

      9 diagrams, and wrote a report. Khalid al Fawwaz paid for my

      10 expenses and the photo enlarging equipment. He was in Nairobi

      11 at this time.

      12 I later went to Khartoum, where my surveillance files

      13 and photographs were reviewed by Usama bin Laden, Abu Hafs,

      14 Abu Ubaidah, and others. Bin Laden looked at the picture of

      15 the American Embassy and pointed to where a truck could go as

      16 a suicide bomber.

      17 In 1994, Bin Laden sent me to Djibouti to do

      18 surveillance on several facilities, including French military

      19 bases and the American Embassy.

      20 In 1994, after an attempt to assassinate Bin Laden, I

      21 went to the Sudan in 1994 to train Bin Laden’s bodyguards,

      22 security detail. I trained those conducting the security of

      23 the interior of his compound, and coordinated with the

      24 Sudanese intelligence agents who were responsible for the

      25 exterior security.

      In 1994, while I was in Sudan, I did surveillance

      2 training for al Qaeda. Ihab Ali, also known as Nawawi, was

      3 one of the people I trained. Nawai was supposed to train

      4 others.

      5 In early 1990s, Zawihiri made two visits to the

      6 United States, and he came to United States to help raise

      7 funds for the Egyptian Islamic Jihad. I helped him to do

      8 this.

      9 I was aware of certain contacts between al Qaeda and

      10 al Jihad organization, on one side, and Iran and Hezbollah on

      11 the other side. I arranged security for a meeting in the

      12 Sudan between Mughaniyah, Hezbollah’s chief, and Bin Laden.

      13 Hezbollah provided explosives training for al Qaeda

      14 and al Jihad. Iran supplied Egyptian Jihad with weapons.

      15 Iran also used Hezbolla to supply explosives that were

      16 disguised to look like rocks.

      17 In late 1994, I was in Nairobi. Abu Hafs met another

      18 man and me in the back of Wadih el Hage’s house. Abu Hafs

      19 told me, along with someone else, to do surveillance for the

      20 American, British, French and Israeli targets in Senegal in

      21 West Africa.

      At about this time, late 1994, I received a call from

      23 an FBI agent who wanted to speak to me about the upcoming

      24 trial of United States v. Abdel Rahman. I flew back to the

      25 United States, spoke to the FBI, but didn’t disclose

      A former FBI official has claimed Anas al-Libi was taken in for questioning by British police but released from custody in 1990s.

      “You can be certain he’ll skip town before we have time to sort through all the evidence and find something – which I’m sure is there,” Mr O’Neill, who died in the September 11 attack, reportedly said.

      It is unclear why al-Libi would not have been extradited to the US, where he had already been indicted for the attacks. He indeed fled, according to Mr Soufan, evading surveillance by a team following him.

      Closer inspection of al-Libi’s possessions turned up a book later dubbed the “Manchester Manual”, which contained instructions to al-Qaeda operatives for carrying out attacks and enduring interrogation.

      It was alleged in 2002 that al-Libi was a member of a Libyan al-Qaeda cell that received hundreds of thousands of pounds from British intelligence to assassinate Gaddafi in an ultimately unsuccessful plot.

      The allegation was made in a book by two French intelligence experts, who claimed the mid-1990s plot led Britain to play down the first international arrest warrant for bin Laden, issued by Libya in 1998.

    US military forces conduct 2 major terror raids, seize Al Qaeda leader behind 1998 embassy bombings

    Abu Anas Al Liby in Tripoli, Libya. Liby, also known as Nazih Abdul-Hamed al-Ruqai, was wanted in connection with the 1998 bombings of the American embassies in Kenya and Tanzania.

    Pentagon spokesman George Little said in a statement that Al Liby “is currently lawfully detained by the U.S. military in a secure location outside of Libya.” Sources told Fox News that he will be read his rights by an elite FBI unit that was sent out for that purpose. US officials say that the Justice Department plans to prosecute him in a U.S. court.

    Al Liby is on the FBI’s most-wanted list with a $5 million bounty on his head. He was indicted by a federal court in the Southern District of New York, for his alleged role in the bombings of the United States Embassies in Dar es Salaam, Tanzania, and Nairobi, Kenya, on August 7, 1998, that killed more than 220 people.

    He is believed to have spent time in Sudan where Usama bin Laden was based in the early 1990s. After bin Laden was forced to leave Sudan, Al Liby turned up in Britain in 1995 where he was granted political asylum in Britain under unclear circumstances and lived in Manchester. He apparently fled Britain in 2000 when his name was added to the FBI’s most wanted list.

    Comment:

    This is an important arrest. A couple hundred died in the 1998 embassy bombings. Zawahiri had wanted to target the intelligence apparatus in Africa but mainly killed locals working at the embassies.

    The former Zawahiri associate supplied virulent Ames by Bruce Ivins, who was taught microbiology by Heba Zawahiri, lived in Sudan where his mother taught business at the university in Khartoum. He would visit Cairo as a child and later moved back to Cairo. Tarek attended Cairo Medical where Dr. Ayman would come on Fridays to recruit Tarek’s childhood and medical school friends to jihad. My friend, author of INSIDE JIHAD, who sometimes consults for intelligence agencies, reports that he resigned from the group when his colleagues asked him to bury a security officer near the mosque.

    Did Abu Anas Al Liby know the DARPA scientist while in Khartoum? (I have no idea).

    Hillary Clinton, on the subject of extraordinary rendition, Al Gore once famously said “He’s a terrorist. Go grab his ass.”

    But with the Al Qaeda WMD anthrax scientists Rauf Ahmad and Yazid Sufaat, didn’t the US fail even to pursue extradition under the rule of law under existing extradition treaties? (I have not read and am not informed on the particulars of the treaties). Even absent extradition, don’t the millions in appropriations warrant a little cooperation from Pakistan and Malaysia?

    If you were President, would you reopen Amerithrax — or would you let it lie, as did the WH under Obama, because you didn’t want to undermine the public’s confidence in the FBI? Didn’t the failure to reopen the investigation merely serve to undermine confidence in the WH? United States Taylor was wrong while at Justice and was wrong when he served in the White House. Don’t we have the greatest confidence in the FBI when we see that the FBI and prosecutors correct missteps and accurately assess the significance of gaps in evidence? Isn’t the entire trend on forensic evidence to insist that it lead to sound and verifiable conclusions? That it be validated science?

    And why should it take over a decade to bring the 911 operatives to trial? How is that justice? How does that serve the interest of national security? Is it going to take another decade to bring Al-Liby to trial?

      A raid on Manchester’s flat resulted in an 180-page al-Qaeda ‘manual for jihad’ containing instructions for terrorist attacks. Did that manual contain the instructions on “Poisonous Letters”?
      Offhand, I recall it only to instruct on resistance to interrogation.

        Kurt Eichenwald in 500 DAYS (2012) spends 4 pages of the densely packed discussion of the Manchester Manual in the endnotes in support of his point that a statement by Cheney on this subject of Al Qaeda and anthrax was mistaken. Kurt’s argument, however, is a straw man argument — Cheney’s statement, as phrased, is 100% correct and would refer to Volume 11 of the Encyclopedia of Afghanistan Resistance.

        A new volumes, number 11, was devoted solely to chem-bio and it was that volume 11 of the Encyclopedia Resistance that gave the instruction on poisonous letters and instructed that the inside of the envelope be covered with a silicone sealant to avoid killing the mailman.

      According to a US indictment, he “conducted visual and photographic surveillance of the US embassy in Nairobi” in 1993, five years before it was bombed.

      The bombings he is accused of having involvement in killed more than 200 people. A courtroom in New York is the likely next destination for a man whose work with al-Qaida has taken him across the globe.

      Anas Al-Liby was on the Al Qaeda shura council, along with Saif Adel, when Bin Laden’s colleague stabbed the eye of a corrections officer. Defense counsel always seem forget to mention that when they complain of a detainee being strip search and shackled. Corrections needs to be on top of their game with these detainees and judges and their clerks need to understand the history and security concerns.

      A former top aide to Osama bin Laden had created a dramatic escape plan to take hostages and make demands just before trial in the bombings of two U.S. embassies in Africa, prosecutors say.

      The plot was discovered after Mamdouh Mahmud Salim stabbed a guard, leaving him critically injured, and stole his keys on Nov. 1, prosecutors said in lodging new charges of attempted murder and conspiracy to escape against him.

      Salim, 41, alleged to have served as the finance chief for bin Laden, was arrested in Germany in September 1998. He was already charged with conspiracy in the international plot to kill Americans.

      The new charges, including attempted hostage taking, were contained in an indictment Wednesday that also added five new defendants – raising to 22 the number accused in the Aug. 7, 1998, embassy bombings.
      Of the 17 previously charged, five are awaiting trial in New York, three are awaiting extradition from Britain and eight remain at large. One man has already pleaded guilty.

      The attacks allegedly were approved by bin Laden, a Saudi millionaire, as part of the effort by his terrorism group, Al Qaeda, to kill Americans wherever they can be found.

      Two of those newly charged – Saif Al Adel, an Egyptian, and Anas Al Liby of Libya – allegedly sat on a consultation council for Al Qaeda. The council, the indictment said, discussed and approved terrorist operations.

      The bombings at embassies in Nairobi, Kenya, and Dar es Salaam, Tanzania killed 224 people, including 12 Americans. If convicted, each of the new suspects could face life in prison without parole.

      Four men already in custody in New York are scheduled to go to trial Jan. 3. Salim was to have joined them on trial but will not because of the attack on the guard.

      Salim pleaded innocent to the charges Wednesday after he was brought to court under heavy guard. His lawyer, Allan Haber, said he had no comment.

      Most of the new material in the amended indictment unveiled Wednesday described Salim’s alleged attempt to escape the Metropolitan Correctional Center in Manhattan.

      It said Salim interrupted a meeting with his defense lawyers to ask a corrections officer if he could return to his cell to obtain more legal materials. Minutes later, Salim allegedly stabbed the guard in the eye with a comb that had been filed down to a point.

      He then allegedly handcuffed the guard, took his keys and followed a plan sketched on notes in his cell to tamper with an electrical junction box and block the lens of a surveillance camera inside his cell.

      When other officers responded, Salim allegedly stabbed one of them with another improvised weapon, punched at them and sprayed them with irritants fashioned from liquids obtained as food items.

    The 1,000-page volume, published Monday, describes an organization that fought Hitler with stunning success but struggled to combat Soviet espionage during the Cold War and initially failed to grasp the threat from Islamic extremism.

    The book says that in 2000, MI5 without realizing it at the time foiled a plot by al-Qaida to obtain biological weapons when it found samples and equipment in the luggage of a Pakistani microbiologist, Rauf Ahmad, who had attended a conference on pathogens in Britain. U.S. intelligence later revealed that Ahmad had been in touch with al-Qaida’s No. 2, Ayman al-Zawahiri.

      1.(S) Summary: In response to emerging infectious diseases such as avian influenza, Pakistan is rapidly developing plans to enhance its public health infrastructure, including biocontainment facilities and national regulations on the safe handling of dangerous pathogens. The Department’s Biosecurity Engagement Program (BEP) began work with the Government of Pakistan (GOP) in 2007 to assist in developing safe, secure and sustainable public health infrastructure that ensures transparency, meets international standards and fosters collaboration with the U.S. and other international partners. Over recent weeks, BEP representatives in Islamabad have met with GOP officials, many of which requested assistance in the construction of proposed biosafety level 3 (BSL3) facilities and increased collaboration with BEP. The Executive Director of Pakistan’s National Institute of Health also expressed interest in a personnel reliability program to screen for “extremists” or other groups looking to gain access to pathogen collections. This cable is the second in a series of five outlining BEP progress in Pakistan. End summary.

      2.(SBU) In a follow up to summer 2007 meetings with Ministry of Health (MOH) officials in Islamabad, BEP Director Dr. Jason Rao met with Secretary of Health Khushnood Akhtar Lashari, who proposed further areas of collaboration. Lashari thanked the BEP for its sponsorship of MOH staff to attend biosecurity training sessions and emphasized the training’s positive impact on the Ministry. Secretary Lashari requested further U.S. assistance to develop biosafety guidelines, a resource center for biosecurity and biosafety training and undertake a national survey of potentially dangerous pathogens. Lashari has appointed a team to develop national biosafety guidelines, as well as begin a baseline survey of pathogens in the country’s research institutions. The Secretary commented that Pakistan’s National Association of Pathologists, the lead organization on both of these initiatives, lacked expertise to carry the projects to completion.

      ASSISTANCE FOR BIOSAFETY LEVEL THREE LABORATORIES

      3.(SBU) Pakistan’s National Institute of Health (NIH) has begun work on a biosafety level three (BSL3) laboratory. Initial plans call for the lab to be modular and pre-fabricated, located inside a brick and mortar shell. The outer shell is currently under construction. According to NIH officials, lab construction has stalled due to funding shortages. Details on the manufacturer of the modular lab, engineering design and time line for completion were not disclosed. NIH Executive Director, General (retired) Dr. Masood Anwar, expressed concerns about laboratory design flaws and cost overruns and requested BEP assistance in reviewing design implementation. BEP has begun to work with MOH staff to develop an action plan for implementation. Executive Director Anwar invited BEP representatives to join weekly BSL3 lab working group meetings.

      4.(S) Representatives of the Pakistan Agricultural Research Center (PARC) also requested assistance in the design and operation of a planned BSL3 facility to be built at PARC headquarters in Islamabad. The Japan International Aid organization (JICA) has agreed to sponsor most of the laboratory construction costs. BEP plans to eventually provide substantive experts to the PARC BSL3 working group. PARC houses a full range of viral and bacterial pathogens, including dangerous agents such as anthrax, FMD (foot and mouth disease), brucellosis and highly pathogenic avian influenza. Virtually no biosecurity measures were observed during March and June 2007 visits to PARC, but by early February 2008, dedicated safety officers and improved security practices were in place.
      DEFENSE SCIENCE AND TECHNOLOGY ORGANIZATION

      5.(S) The Defense Science and Technology Organization (DESTO) has requested meetings with BEP officials to continue discussions on biological and chemical safety. BEP has met several times with DG Major General Guftar Shah. Shah requested BEP involvement in DESTO’s development of a biological and chemical detection and response capability, both to ensure transparency and add technical insight. Shah has led two delegations to the U.S. to initiate collaboration in this area and BEP teams toured the Armed Forces Institute of Pathology in March 2007 and provided biosafety training to AFIP personnel in June 2007. BEP also plans to tour DESTO’s Karachi facilities to provide a baseline assessment of safety and security practices there. COMMENT ISLAMABAD 00000581 002 OF 002

      6.(SBU) The BEP has utilized engagement, training and exchanges to highlight the importance of biosecurity to GOP representatives and its role in non-proliferation efforts. Several ministries view the program as adding value to Pakistan’s efforts to combat both bioterrorism and emerging infectious diseases. BEP assistance serves a dual benefit in addressing real threats to international security while at the same time strengthening efforts to safely and transparently expand Pakistan’s public health infrastructure. We hope that this synergy will increase as a result of the establishment of a dedicated BEP office in Pakistan. PATTERSON

    In an exit interview, FBI Director Mueller says he was faced with the challenges of law enforcement when prevention of the next attack was the paramount priority — rather than prosecution.

    Even before that, however, the administration of justice raised difficult questions.

    The news today reports that the cost of incarcerating one prisoner in New York City costs as much as a year of Ivy League education.

    So when is the cost of prison time warranted? When is it needed to deter? When is it needed to protect the community? When does the absence of prison allow one to profit from a crime?

    When is prison time needed to deter scientists from working with Al Qaeda in developing an WMD? These matters are hard to judge given the FBI’s failure to comply with FOIA and the absence of the sort of government accountability in Amerithrax that there was in Blackwater. (Both matters involved the same lead AUSA, Kenneth E. Kohl; at a minimum, Ken could not focus on Amerithrax after Ivins’ death given the mess he came to be in on Blackwater).

    The person who as head of the Boston FBI office oversaw the Isabella Gardner investigation — and the fellow who planned the robbery — are both in the news this month. The FBI official was being prosecuted and the felon was promoting his book (and a movie deal). (The FBI Boston head then went to head criminal investigations for the FBI nationally.)

    I’ve suggested a speculative Isabella Gardner theory that had Joe Murray — who had a former FBI agent Fitz working for him shortly after the robbery — paying $300k to Mello’s crew (including Robert Guarente) for the paintings after the state authorities rejected Carmello Merlino’s and David Turner offer to return the paintings on a cocaine distribution charge. Joe Murray was an independent but had a working relationship with the mob. He didn’t live far from Robert Guarente in Maine. Murray then died precipitously — as did later his wife.

    Always preferring a theory where “X” marks the spot and a hypothesis can be tested, I liked the treasure being under this concrete slab at the abandoned farmhouse pictured in Maine. His friend from CT, who visited him in Maine, was in the concrete slab laying business at the time. (If the FBI used ground penetrating radar at the location — and I don’t know if they did like they did in CT — I don’t know whether it would work for the ground under the slab.

    I watched “Parker” last night on Netflix — Jason Statham, the criminal, had a code and reminds me of Joe Murray at least in his looks and that he was an independent. Jason Stratham’s character felt it was the principle — not the money — that was important. If I wanted to learn more about Isabella, I would call Robert Guarente’s former son-in-law and ask him whether the paintings might be somewhere in Maine (rather than CT or Philly as the FBI suggests Guarente took them to offer them to the mob).

    But I also credit the view that most of the paintings are ruined based on the informant’s report from Merlino’s garage that I once uploaded. Those pitching book and movie deals are slow to agree with the hearsay informant’s report recorded in the FBI files that all but two of the paintings are ruined — with the two main paintings in rough shape.

    In a matter-of-fact tone, he said he’d planned a heist of priceless art from Boston’s Isabella Stewart Gardner Museum in 1988, a couple of years before the museum was robbed.
    Connor was in federal prison when the robbery took place, so he wasn’t involved. But he said his crew was hired by others in 1990.

    In his Patriot Ledger interview he scoffed at the FBI’s belief that some of the art stolen from the Gardner Museum may be in the Philadelphia area.
    Connor said the pieces are “all the way around the world” – probably in Saudi Arabia, where they’ll never be recovered.

    WASHINGTON, Oct. 31 (UPI) — The FBI has deactivated an investigation into a Pakistani scientist working on anthrax for the al-Qaida terror group, The Washington Post reported Tuesday.

    The role of Abdur Rauf, 47, came to light in December 2001 when a stack of letters was found by coalition troops in Afghanistan during a raid on an al-Qaida house. The letters showed Rauf was reporting to the terror group’s No. 2 leader, Ayman al-Zawahiri, on his bid to create large amounts of deadly anthrax as a biological weapon.

    In one chilling but unexplained exchange, Rauf wrote: “I successfully achieved the targets.”

    At the United States’ request, Pakistani authorities detained Rauf for questioning soon after the letters were found, but he was release since Pakistan says it has no grounds for arrest.

    Faced with the diplomatic standoff, the FBI put Rauf’s case on inactive status last year, a source who asked not to be identified told the Post.

    “We will never close the door, but the chances of getting him into the United States are slim to none,” the official said.

      The lead prosecutor, Mr. Seikaly, who came over from the CIA in mid-September 2001, had previously worked at DOJ in charge of foreign extraditions etc. Certainly, he was highly expert and highly qualified in arranging, one way or the other, the presence of terrorists in the US.

      As I best recall, in 1996 or so the CIA sent a jet with blackened windows to Qatar to pick up KSM. He was in a cell with Islambouli. But someone tipped KSM off — KSM was connected to the religious minister there.

      At the CIA, Mr. Seikaly, I believe, was in the Inspector General’s office and wrote the report that got a former CIA Director in trouble for bringing a laptop home that had classified maps of Afghanistan home (so that he could work at home).

      Who does Mr. Seikaly think is responsible for the Fall 2001 anthrax mailings?

      How did the failure to obtain Rauf Ahmad’s presence in the US impair or influence the course of the Amerithrax investigation?

      Was Dr. Hamouda, the fellow supplied virulent Ames by Bruce Ivins who had been taught microbiology by Heba Zawahiri, at the conference in the UK with Rauf Ahmad? The SFAM director told me that Rauf Ahmad was there both in 1999 and 2000.

    Valerie Parlave, the new heard of the DC Field Office, is a small-town girl from Upstate New York, who went to Colgate and Albany Law School. I just picked up tickets at Hamilton College to hear Mrs. Clinton speak and am reminded how beautiful the area around Colgate and Hamilton would be to go to school.

    “Just through good honest hard work and stick-to-it-iveness, she’s one of the top people in the FBI now. That’s exciting, and it’s exciting for her.”

    In the usual case, the FBI’s DC Field Office could be understood to be way too busy for its head to spend much time looking back. Along with New York City, it is ground zero for numerous counter-intelligence threats.

    But as the new FBI head in Boston appreciates, Al Qaeda remains a serious threat. Dr. Zawahiri’s anthrax program should be understood to be unfinished business. Adnan El-Shukrijumah, for one, is still at large (as is Rauf Ahmad).

    Yazid Sufaat’s case will be heard in November — though I won’t pretend to understand Malaysia criminal procedure.

    The FBI failed to take custody of Rauf Ahmad and Yazid Sufaat because Pakistan and Malaysia are sovereign countries — and there is no extradition treaty. The failure was in not obtaining the defendant’s presence in the United States as was done with so many others. But it is still important to understand that the access to the one scientist, Rauf Ahmad, was over tea and cookies — and that in the case of Yazid Sufaat, the FBI first interviewed him in November 2002, nearly a year after his capture. The 1/2 hour interview focused on how he knew Zacarias Moussaoui.

    President Bush claims that the FBI did not know the extent of Al Qaeda’s anthrax program until after KSM was captured in March 2003. That was when Yazid opened up a little, thinking he had been betrayed by KSM. But it would be terribly naive for the FBI to think that Rauf Ahmad was fully cooperating — given he told lies for two days. Rauf only had reason to tell so much as was plain from the documents that this blog has uploaded. Yazid too has said that he was not cooperating because he was angry at the Malaysian government for arresting him.

    FBI Director Mueller personally went to Malaysia on this issue and came back without Yazid Sufaat. GAO should obtain the documents from March 2002 regarding the FBI’s attempt to bring Sufaat home. Let’s hope the new director, Director Mueller’s friend, has more success when such issues arise.

    Williams, Dennis O. Fidelity Bravery Integrity No Way! Dorrance Publishing Company 2009

    In 1979 FBI Supervisory Special Agent Dennis O. Williams moved across the country when he was promoted from the FBI’s Los Angeles Division to a supervisory position at FBI Headquarters. Soon after his arrival, Williams discovered that the mover had defrauded the FBI by billing for a higher weight of his household goods than actually existed. As Williams pursued the matter, he discovered a cover-up at FBI HQ; his attempts to expose this conspiracy resulted in his receiving threats and becoming the subject of retaliation. Though an investigation by the FBI Washington Field Office demonstrated that Williams was correct in his suspicions, the cover-ups continued for decades, eventually leading to a conspiracy to deceive the Senate Judiciary Committee regarding an inquiry into the involvement of Thomas J. Pickard.

    Pickard was the acting director of the FBI when 9/11 occurred, despite Williams’ repeated warnings to the White House that Pickard did not have the integrity for such a position. The 9/11 Commission report reflects that the Phoenix Division of the FBI produced a memorandum dated July 10, 2001, advising FBI HQ that an inordinate number of supporters of Osama Bin Laden had attended civil aviation universities and colleges and would be in a position to conduct terror activity against civil aviation targets. Williams believes that Pickard’s testimony that no managers at FBI headquarters saw the Phoenix memo before September 11 constitutes a red flag indicating a conspiracy to defraud the 9/11 Commission.

      While I appreciate the detailed list, and will mine it for books to keep an eye out for at book sales, it is fallacious to argue the merits of a true crime matter based on the alleged missteps and excesses of the investigator or prosecutor. Politics has no role in true crime analysis.

      On the other hand, it is useful to consider whether there were particular excesses and missteps that particularly apply in Amerithrax.

      Toward that end, I note that at 10 a.m. this morning there will be a press conference by the ACLU on the subject of FBI’s alleged missteps and excesses. The ACLU likely regrets the choice of date given that any press conference will be drowned out by developments in the Navy shooting case.

      For example, IMO the DOJ provably withheld exculpatory documents relating to Dr. Ivins work with the 52 rabbits — which explained why he was in the lab those nights.

      The GAO needs to study that issue.

      A US judge has ordered a retrial in the case of five officers convicted of charges related to deadly shootings on a bridge after Hurricane Katrina.

      The 2011 case was tainted by “grotesque prosecutorial misconduct” after three lawyers posted anonymous comments on a news website, ruled the judge.

      The justice department said it was now considering its options.

      A family member of one of the victims of the shootings said the decision had re-opened a “terrible wound”.

      Two unarmed men were killed by police on the Danziger Bridge in New Orleans, Louisiana, less than week after Hurricane Katrina struck in 2005.

      ‘A bitter pill’

      Five former city police officers co-operated with a justice department investigation and pleaded guilty to engaging in a cover-up to make the shootings appear justified.

      Five other officers were tried on various charges of cover-up, firearms offences and civil rights violations.

      Former US Attorney Jim Letten resigned in December 2012 after two top prosecutors in his regional office admitted posting anonymous comments about the case on nola.com, the website of the New Orleans Times-Picayune newspaper.

      A wider investigation found a third lawyer, based in the justice department’s civil rights division in Washington DC also posted anonymous comments on the website during the last week of the trial.

      In Amerithrax, I know of no instance where a prosecutor posted anonymous comments on an internet forum. Instead, in 2002 and 2003 the lead prosecutor provided information to reporters anonymously. The leaks were about “anthrax-smelling” dogs and other nonsense. The lead prosecutor pled the Fifth Amendment in civil depositions. (His daughter then came to represent lead anthrax weapons suspect Ali Al-Timimi for free.

      In such a case, sources should be documents and named sources.

      In the case of Mr. Willman’s book, he did an excellent job of identifying his sources. He identified the person giving the information and the date of the interview. Those notes provide a roadmap as to where things went off track — who was confused and mistaken about what.

    Not only was Al Qaeda anthrax scientist Rauf Ahmad a government scientist but Yazid Sufaat was a government scientist. Yazid admits that he had been part of a secret biological weapons program before it was abandoned by Malaysia.

    Before his arrest this year, Yazid Sufaat did not deny to me (in email and instant message) that Al Qaeda was using virulent Ames.

    Stateside, infiltrator Ali Al-Timimi shared a suite with the Battelle consultants Alibek and Bailey who co-invented a patent to grow concentrated anthrax using silica in Spring 2001.

    Experiments using the virulent Ames used by the DARPA-funded researchers was done in downtown Frederick Maryland. Dr. Alibek told me that he knew that Ali Al-Timimi was a hardliner but otherwise did not know him except to pass him in the hallway.

    The head of the ATCC repository, to which Ali Al-Timimi had unfettered access, came to head the FBI Amerithrax science investigation.

    The Ames researcher who came to head the SRI B3 lab where the work with Ames was done, Patricia Fellows, had been an Ivins assistant.

    It was her unsubstantiated accusations that have provided the underpinning of the FBI’s finely spun cotton-candy “Ivins Theory.”

    FBI documents released to the public in 2011 contain strong evidence that the anthrax spores used in the letter attacks of 2001 had been prepared previously for U.S. biodefense purposes. We have recently compiled and analyzed the documents, which contain some 10,000 pages of scientific data, in the “Journal of Bioterrorism & Biodefense.”*

    Although genetic analysis indicates that anthrax spores in a flask at the U.S. Army Medical Research Institute for Infectious Diseases are the likely parental source from which the letter spores were grown, the USAMRIID spores do not contain two extraneous chemical elements and a non-anthrax type of spore found by the FBI in the letter anthrax; nor has evidence been found at USAMRIID for any use of these items.

    The two chemical elements, tin and silicon, must have been added to process the letter spores following their growth, for the toxicity of tin would have prevented growth, and the uniquely high silicon content of the spores has never been replicated during growth. The two chemicals are components of a well-known type of protective coating called silicone (a complex substance containing the element silicon). Silicone has been used in the past to encapsulate pharmaceuticals in order to protect them from inactivation by external hazards without impairing their biological action.
    Microencapsulation of the attack spores with silicone would explain the presence, locations and amounts of the two extraneous chemical elements, for which no other explanation has ever been offered. Methods are available for determining whether or not silicone is present in the attack spores, but there is no evidence that this has been done.

    In the case of biological weapons like anthrax, microencapsulation could be used to prevent their detection as well as to protect them from inactivation. A plan to test the effects of microencapsulation on the detection of pathogens was spelled out in the Department of Defense’s unclassified annual budget justification documents issued in 1999, 2000 and 2001 for the Biological Warfare Defense program, under which DARPA (the Defense Advanced Research Projects Agency) was developing a biological weapons detection system. The budget document for 2002 stated that the plan had been accomplished in 2001. Evidently, the DARPA project had been supplied with microencapsulated pathogen(s) in the year of the letter attacks. Dry anthrax spores were one of the pathogens known to be under study by DARPA in 2001. Antibioterrorism training and vulnerability assessment were also underway in the U.S. at the time and may have utilized any anthrax spore preparations that were available.
    Only one laboratory, the Army laboratory at Dugway Proving Grounds in Utah, is known to have made active, dry anthrax spores (an arms-control, treaty-sensitive activity) before the attacks. In its Department of Defense budget justification, Dugway also expressed an interest in microencapsulation. FBI data indicate traces of tin in some anthrax spores made there, but not in any spores made elsewhere. Battelle Memorial Institute was operating the Dugway laboratory in 2001. Battelle possessed anthrax spores that have been shown by the FBI to be a genetic match with the letter spores.
    Both Dugway and Battelle utilize dry spores of Bacillus subtilis, a related but non-pathogenic bacterial species that is frequently used as a convenient simulant or model for anthrax. The non-anthrax contaminant found in the letter anthrax is a sub-species of Bacillus subtilis that has a unique genetic sequence, making it a potential institutional “fingerprint.” The FBI did not find it at USAMRIID. There is no evidence that they searched Dugway or Battelle.

    When viewed together, these facts imply that the attack spores were processed with tin-and silicon-containing materials under government auspices, probably to microencapsulate them for use in detection and other defense studies. The process of spore microencapsulation requires special expertise, specific documented chemicals, and sophisticated facilities. The known clues point to Dugway or Battelle, not USAMRIID, as the site where the attack spores were prepared. Crucial evidence that would prove or disprove these points either has not been pursued or has not been released by the FBI.
