    At USAMRIID, there should have been a direction to preserve documents relating to work with virulent Ames. The USAMRIID is quick to rely on the fact that it destroyed the relevant documents relating to the use of virulent Ames in September 2001 and October 2001. Instead, effort should have been to show that USAMRIID’s retention of documents was consistent with its duty to preserve such documents.

    Lawyers who draft “document retention policies” appreciate that they really are drafting “document destruction policies.”

    In October 2001, it was widely known that Bruce Ivins had the largest repository of Ames in the country. He was the “go-to” guy for virulent Ames.

    In October 2001, the FBI should have collected all documents relating to USAMRIID B3s and retained the documents.

    USAMRIID Command would have gladly cooperated. Constitutional limits on the FBI have no application because provision of the information would have been by consent.

    These rooms are within the “hot suite” — the key card entry is passed in getting to these rooms. Many outsiders did not understand this. Those people needed to read more.
