ORDER SUA SPONTE STRIKING DEFENDANT’S “NOTICE OF ERRATA”

AS UNAUTHORIZED AMENDMENT TO EARLIER SUBMISSIONS

So it appears that the judge has retracted the DOJ retraction. So the original filing stands? And now the DOJ is back on record saying that Dr. Ivins’ lab lacked the “specialized equipment in a containment suite” needed for Ivins to have dried the deadly powder.

    In the Motion to Amend filed July 27, DOJ now reasons that Dr. Ivins used a Speed-Vac, as distinguished from the large lyophilizer.

    The Speed-Vac has previously been addressed but we can revisit the question as often Rachel keeps changing her suggested theory.

    Also, it suggests that as to distribution to Covance, for example, it likely had been irradiated and so that doesn’t count.

    But we can let the document, in all of its magnificence, speak for itself.
