The New York Times says the FBI’s anthrax case has “too many loose ends.” Find out where some of those looses ends might have originated in my novel CASE CLOSED. Sure it’s fiction, but many readers, including a highly respected member of the U.S. Intelligence Community, think my premise is actually “quite plausible.”

    It was Lab Notebook 4241 that reported on this experiment. It was withheld until long after the FBI issued its report. The FBI withheld even this email from October 5, 2001. Why didn’t Ivins tell them what his Notebook and emails showed about how he spent his time? The reason is that they withheld the documents from him. The FBI took the only copy of Lab Notebook 4241 and wouldn’t give it back. Similarly Bruce tried but was unable to retrieve his old emails. In the past I have uploaded the emails showing his attempt to obtain the documents that would permit him to reconstruct his time from a half decade earlier. (None of us would be able to 5 months ago — let alone 5 years ago.

    The above montage is of critical importance to document fully. Although it seems painful and obvious, the pieces have to be completely documented and linked and quoted appropriately.

    The 302 that it takes 2 hours. Link, name of document, quotation, page of quotation. This has to have both the link for Internet, but also the document name, page number, quote as if in old days of paper.

    The Oct 5 email where Ivins refers to last 3 days. Quote the full thing. Give the link.

    Same info for summary report. Link to it. But also name it, page number, quote from it.

    As a supplement, the emails sets going back to August, the last 2 or 3, all have emails that talk about this rabbit experiment coming up. (There is also an email or two the morning of Sep 18 between 7 am and 8 am. These are a separate set to narrow the mailing window.)

    By assembling the set of links and quotes and document names and page numbers, it makes it available for others to point to or pull in.

    This critically undermines a key part of the FBI/DOJ theory that Ivins was using the lab in late night hours the October week. That was the week of the Senate anthrax production and processing. That anthrax was higher quality. The DOJ theory was that Ivins spent the full week of nights from prior weekend to Friday Oct 5 processing and that is why the quality was better. This cuts up most of the week. The Friday Oct 5 email also indicates the experiment is continuing so that more checking in the lab is needed of the animals.

    Ivins apparently did Friday Oct 5 evening. Did someone else check on Saturday and Sunday? That is a path for future investigation to find that person’s emails if they exist. Maybe FOIA can get them. This was possibly an Ivins lab tech. Their names and emails for this period should also be FOIAed.

    The DOJ says Ivins was checking on the end of September weekend. Is that backed up by emails or documents at this point? What is their source or are they just confused?

    There’s a July 1, 2008 that states:

    But this is precisely the sort of email that in comparison to the October 5, 2001 email is irrelevant. This game of engaging in conjecture about a possible motive for theory is not worthy of the DOJ — and if they think it is relevant analysis the DOJ is not suited to national security matters. Instead, the DOJ needed to focus on the documentary evidence that was material and then correctly characterize it.

    FoxNews is running with the fact that Ivins was depressed that it was going to come out that he was a frequent cross-dresser. He committed suicide shortly after testing for human DNA. The FBI apparently did that because 14 of the panties he took from a plastic bag were semen stained. The reasonable conclusion is that he committed suicide because of the humiliation he was going to be put through — not because of any evidence of guilt. He specifically talked about how upset he was that it would come out at the time of the November 2007 search. Combine this with the fact that his superior had ordered all his friends not to talk to him about the case — thus making it impossible for him to marshall a defense — add what he perceived as Mara’s and Pat’s betrayal of him emotionally… and his suicide was readily predicted and in fact the subject of warnings.

    This is very important. It took a lot of effort to find this. This combines with the estimate of 2 hours plus in the FBI 302 you referenced in a recent thread.
    That 302 indicated if there were dead animals it took longer.

    “Results so far” indicates they would continue testing.

    Ivins went in to B3 in the evening of 10/5/01 and the next time is 10/9 and then 10/14.

    Maybe someone else went in the other days that weekend to check the animals since Ivins didn’t?
