  • The chairman of the House Judiciary Committee on Friday urged Attorney General Eric Holder to appoint a special counsel to examine potential abuses by former President Bush’s administration.
  • Rep.  John Conyers, D-Mich., said in a speech to the National Press Club that Holder ”must appoint a special counsel to review the Bush administration abuses of power and misconduct. A criminal probe — he’s got to do that.”
  • Conyers’ committee has sought an investigation of Bush administration moves criticized by Democrats, including its methods of interrogating foreign detainees, use of warrantless wiretaps, alleged retribution against critics, and allegations that officials intentionally misused intelligence.
  • He said the criminal probe should be accompanied by a ”9/11-type panel” to gather facts and make recommendations on preventing the misuse of power.
  • A Justice Department spokeswoman declined comment. Holder is considering whether to appoint a prosecutor to review the Bush administration’s methods of interrogating suspected terrorists.
  • President Obama has expressed reluctance to conduct a probe into alleged Bush-era abuses and resisted an effort by congressional Democrats to establish a ”truth commission,” saying the nation should be ”looking forward and not backwards.”

To Congressman Conyers’ list should be added the Anthrax Investigation Commission proposed by Congressman Rush Holt. The legislation which would create this Commission is currently held in Congressman Conyers’ own Judiciary Committee.

Why hasn’t Congressman Conyers advanced this legislation?

It is abundantly clear that the FBI’s case against Dr. Bruce Ivins is far from compelling, and it seems clear that Dr. Ivins could not have been the sole perpetrator of the anthrax attacks, if he was involved at all.

What is the FBI hiding?

Why did the FBI fail to solve the anthrax case?

Who benefitted from the failure to solve the case?

Who had the power to divert the FBI’s investigation?

    I hope the names of all the people favoring the decision to close the case will be releasable under FOI. It is part of the governmentable accountability furthered by the Government in the Sunshine Act. Also, this 110 page memo and 40 page — and then the still shorter version — is subject to production under FOIA. Judicial Watch should see to it.

    After an October 2001 bombing raid at a Qaeda camp in Darunta, Afghanistan US forces found 100+ printed, typed, handwritten pages of documents that shed light on Al Qaeda’s early anthrax planning. The Defense Intelligence Agency provided me the documents under the Freedom of Information Act. The documents confirmed that it was Zawahiri’s plan to use established specialists and the cover of universities and charities as cover for weaponizing anthrax. From early on, the evidence suggested that charity is as charity does. 90 of the 100 pages are the photocopies of journal articles and the disease handbook excerpts. It was not clear whether or they had yet acquired virulent anthrax or weaponized it, but it was clear that the planning was well along. When Vice President Cheney was briefed on the documents in late 2001, he immediately called a meeting of FBI and CIA. “I’ll be very blunt,” the Vice President started. “There is no priority of this government more important than finding out if there is a link between what’s happened here and what we’ve found over there with Qaeda.” The national security threat even caused the White House to consider using the Army, rather than the FBI, in making some arrests in Western New York State.

    A June 1999 memo from Ayman to military commander Atef said that “the program should seek cover and talent in educational institutions, which it said were ‘more beneficial to us and allow easy access to specialists, which will greatly benefit us in the first stage, God willing.’ ”Thus, in determining whether Al Qaeda was responsible for the anthrax mailings in the Fall of 2001, the FBI and CIA had reason to know based on the growing documentary evidence available by mid-December 2001, that Al Qaeda operatives were likely associated with non-governmental organizations and working under the cover and talent in universities.

    When the leading charity imam was found to have infiltrated the building housing the DARPA-funded Center for Biodefense — and was working in a program sponsored by the American Type Culture Collection (ATCC) 15 feet from the leading anthrax scientist and the former USAMRIID Commander (a prolific Ames strain researcher) — it was easier in 2008 to blame the dead guy who had created the original flask of anthrax years earlier. ATCC came to manage the government’s Critical Reagent Program which prominently featured virulent Ames.

    The lawyer for Ali Al-Timimi describes him in court filing as an “anthrax weapons suspect” and according to his supporters, was the former assistant of the White House Chief of Staff Andrew Card (for 2 months in 1996). It apparently would have been when Mr. Card worked for the automobile association. Oops! Now that’s awkward. Dr. Al-Timimi’s Dad was a lawyer who worked at the small Iraqi embassy in what was a renovated former private residence. It wasn’t Saddam who was responsible for the anthrax — it was the guy for whom the White House Chief of Staff would have have served as a reference in gaining a high security clearance. The Bush Administration would not have been re-elected in 2004 if this had become known. Ali Al-Timimi was known to have been actively coordinating with the 911 imam and Bin Laden’s sheik.

    Ali Al-Timimi had a high security clearance for work for the Navy while at SRA in 1999 where Battelle consultant and former deputy USAMRIID Commander also worked at SRA that year. In the recently unredacted recods relating to flask 1029, there is a March 2001 shipment to University of New Mexico that had received a $5 million grant to work on a Naval biological defense project. Did that sample contain 4 morphs?

    Separately, what accounts for the 100 ml discrepancy — that’s 10 percent of the entire flask – that went missing during the period 5/99 and 2/2000. The recent Army study, rather than providing indirect support for an Ivins theory, greatly undermines it. It supports the idea that not all uses of pathogens are recorded neatly in a log.

    Dr. Al-Timimi’s criminal matter is currently being briefed under conditions so highly classified that not even the defense counsel or the District Court’s clerk are being allowed to see the government’s ex pare filings.
